The US$1.01-billion road project connecting parts of highly populated Cavite and Laguna provinces is among the priority infrastructure projects the Aquino administration will push in 2013.

Public Works Secretary Rogelio Singson told reporters after the inter-agency Infrastructure Committee meeting on Tuesday, October 30, that the the feasibility study on the 4-lane, 47.02 km Cavite-Laguna Expressway (CALAX) project has been completed.

The CALAX project, which will connect the Manila-Cavite Expressway (CAVITEx) and South Luzon Expressway (SLEx), will be among the two projects under the Public Private Partnership (PPP) scheme the Department of Public Works and Highways (DPWH) will pursue in 2013.

“Hopefully, the Cavite-Laguna expressway, will finally proceed next year. These are for rollout since their feasibility studies have been completed. We will now just present it for final approval to the NEDA (National Economic and Development Authority) Board,” Singson said.

The NEDA Board, chaired by President Aquino, gives the last go-signal in the government process for rolling out major projects identified as part of strategies for economic growth.

Two sections

The road project will be divided into two sections: the PPP section and the Official Development Assistance (ODA) section, which multilateral agencies will fund.

The PPP section is the 36.01 km length of the expressway from Kawit, Cavite to Sta. Rosa, Laguna. The ODA section is the remaining 11.01 km part of the road from Sta. Rosa, Laguna to SLEx at Mamplasan Exit in Laguna.

“The private proponent shall be responsible for the financing, designing and constructing of the PPP section, and the subsequent operations and maintenance (O&M) of the entire CALAX,” the PPP Center explained.

Section 4, Rule 74 of the Rules of Court

here’s a recent case on a certain property being sold wherein an annotation at the back of the title was required to be taken out by the BUYER, below is the caption from an offer to buy on the property ….. this annotation applies to cases wherein a property went through an extra judicial settlement.

Seller will be responsible for the cancellation of Sec. 4, Rule 74 of the Rules of Court annotation at the back of the Title.

this is how the annotation looks like at the back of the title :

PE 6000 / RT 70000 7/10/1993

Pursuant to Sec 7 of the Rep Act 26, This Certificate of Title the original of which having been administratively reconstituted is without prejudice to any party whose right of interest in the property was duly noted on said duplicate at the time it was lost or destroyed.

To cancel this annotation would require a petition to be submitted to the Register of Deeds and will take some proceedings, time and legal fees to be taken off the title.

As always, it’s always adviseable to consult a real estate lawyer or go to the register of deeds to ask about their procedure.

RULE 74

SUMMARY SETTLEMENT OF ESTATES Sec. 4. Liability of distributees and estate. - If it shall appear at any time within two (2) years after the settlement and distribution of an estate in accordance with the provisions of either of the first two sections of this rule, that an heir or other person has been unduly deprived of his lawful participation in the estate, such heir or such other person may compel the settlement of the estate in the courts in the manner hereinafter provided for the purpose of satisfying such lawful participation. And if within the same time of two (2) years, it shall appear that there are debts outstanding against the estate which have not been paid, or that an heir or other person has been unduly deprived of his lawful participation payable in money, the court having jurisdiction of the estate may, by order for that purpose, after hearing, settle the amount of such debts or lawful participation and order how much and in what manner each distributee shall contribute in the payment thereof, and may issue execution, if circumstances require, against the bond provided in the preceding section or against the real estate belonging to the deceased, or both. Such bond and such real estate shall remain charged with a liability to creditors, heirs, or other persons for the full period of two (2) years after such distribution, notwithstanding any transfers of real estate that may have been made.

Over 52 million voters will choose who among 44,448 candidates deserve to occupy 18,053 government positions in the country’s second fully automated elections today.

Up for grabs are 18,053 positions: 12 senators, 233 district congressmen, 58 party-list representatives, 80 provincial governors; 80 provincial vice governors; 766 provincial board members; 143 city mayors; 143 city vice mayors; 1,598 city councilors; 1,491 municipal mayors; 1,491 municipal vice mayors; 11,932 municipal councilors; as well as one Autonomous Region in Muslim Mindanao (ARMM) governor; one regional vice governor; and 24 regional assemblymen.

A total of 33 senatorial candidates are vying for the 12 Senate seats while 123 groups are officially qualified for the party-list race.

Six hundred thirty are running for congressman; 202 for governor; 191 for vice governor; 1,755 for provincial board members; 3,894 for mayor; 3,823 for vice mayor; and 33,703 for municipal councilors.

Meanwhile, there are six contenders for ARMM governor; eight for ARMM vice governor and 80 for ARMM assemblymen.

Let’s hope for a PEACEFUL and HONEST election !
