CASE STUDY :
A property owned by a client who recently won a case under the Regional Trial Court ( RTC ) versus their tenants ( not informal settlers ) now wants to sell their property. The title has a “lis pendens” ( illegally done by a governing body ) and the tax declaration on improvement needs to be updated ( the tenants built illegal structures on the property, this would then lead to a questionable amount of improvements done on the property which the owner doesn’t own, didn’t want to build and would rather demolish, ideally, they would rather have a certificate of non-improvement and cancel the tax declaration on improvement ) and finally the tax clearance needs to be issued !
In addition to evicting the client which has a court order already, all these procedures have to be addressed in order to have a prudent and clean sales process ! I will blog on this issue that should have been resolved so much earlier and could avoided other nuisances that occurred due to its delay.
